How would EPPA apply to the employees of tribal casinos operating under the Indian Gaming Regulatory Act regarding Pre-Employment Polygraph testing for employees.

Would they be considered exempt because the casino is own and operated by a government entity?

TV O'Malley answered that question a few months ago in one of the APA magazine "In Your Neighborhood" articles about EPPA. I remember him saying the answer depended upon the particular tribe and the wording of the treaty between them and the government, the status of the land on which the casino sits and who own/runs it.

To my understanding, if the casino is situated on Indian land, as a sovereign nation a tribe or business can't be sued in federal or state court unless it agrees to such a suit or Congress authorizes it. It's my understanding these businesses are exempt from EPPA.
